These Terms and Conditions govern the provision of waste disposal and collection services by Waste Disposal Lewisham to residential and commercial customers within our service area. By booking or using our services you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
In these Terms and Conditions the following expressions shall have the meanings set out below:
Customer means any individual, business, organisation or other entity that books or uses our waste disposal or collection services.
Services means any waste collection, waste removal, rubbish clearance, recycling, disposal or related services provided by us.
Service Area means the locations in which we offer our waste collection and disposal services, including Lewisham and surrounding areas as notified by us from time to time.
Waste means any items, materials, refuse, rubbish or other goods presented to us for collection or disposal, excluding items that we are not permitted to handle under law or under these terms.
2.1 We provide waste disposal and waste collection services for domestic and commercial customers within our Service Area. The exact nature of the Services, including the type and volume of waste to be collected, will be agreed at the time of booking.
2.2 We reserve the right to refuse to collect certain items, including but not limited to hazardous waste, clinical waste, asbestos, gas bottles, chemicals, solvents and any other items prohibited by law or which we reasonably consider unsafe to handle.
2.3 Any description of Services on our website, in promotional material or given verbally is for guidance only and does not form part of these Terms and Conditions unless expressly stated in writing.
3.1 Bookings for waste disposal and collection services can be made by telephone or any other method we may make available. All bookings are subject to availability and acceptance by us.
3.2 When making a booking, the Customer must provide accurate and complete information about the type, quantity, approximate weight and location of the waste to be collected, as well as any access restrictions and any other relevant details.
3.3 We will provide an estimated price and a proposed date and time window for the collection based on the information given. This estimate is not binding and may be adjusted if the actual volume or type of waste differs from that described at the time of booking.
3.4 A booking is only confirmed once we have accepted it and issued a booking confirmation. We reserve the right to decline any booking at our discretion.
4.1 The Customer is responsible for ensuring that our staff and vehicles have safe and adequate access to the premises and to the waste to be collected at the agreed time.
4.2 The Customer must ensure that any necessary permissions for access, parking or loading are obtained in advance and that any permits or authorisations required from local authorities or third parties are in place.
4.3 If access to the premises or waste is blocked, unsafe or otherwise not as described, we may, at our discretion, either cancel the visit and charge a call-out fee or wait until the issue is resolved, which may incur additional charges.
4.4 The Customer is responsible for ensuring that the waste presented for collection does not contain any prohibited or hazardous items and is presented in a safe and secure manner.
5.1 All prices are quoted in pounds sterling and may be subject to value added tax or other applicable taxes where required by law.
5.2 Any quotation given prior to collection is an estimate only and is based on the information supplied by the Customer. We reserve the right to adjust the final price if the waste collected differs in volume, weight, type or accessibility from that originally described.
5.3 Our pricing may take into account labour, transport, disposal fees, recycling costs, local transfer station charges and any additional services requested by the Customer.
5.4 We will advise the Customer of any change to the estimated price before commencing work wherever reasonably practicable. If the Customer does not agree to the revised price, we may cancel the service and the Customer may be liable for a reasonable call-out charge.
6.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing, payment is due either in advance or immediately upon completion of the Services.
6.2 We may accept payment by cash, debit card, credit card or other methods we make available from time to time. We are not obliged to accept any particular method of payment.
6.3 For business Customers, we may at our discretion agree to provide Services on account, subject to satisfactory credit checks and agreed payment terms. Where account facilities are granted, invoices must be paid in full by the due date shown on the invoice.
6.4 If any payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate and to suspend further Services until full payment has been received.
7.1 The Customer may cancel or amend a booking by contacting us using the details provided at the time of booking.
7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation charge will normally apply, unless specific arrangements or costs have already been incurred by us in which case a reasonable fee may be charged.
7.3 If the Customer cancels within 24 hours of the scheduled collection time, or fails to be present at the premises at the agreed time where attendance is required, we reserve the right to charge a cancellation or missed appointment fee to cover our costs.
7.4 We reserve the right to cancel or reschedule a booking at any time due to circumstances beyond our reasonable control, including but not limited to vehicle breakdown, staff shortage, severe weather, safety concerns or changes in legal or regulatory requirements. In such cases, we will use reasonable efforts to notify the Customer and arrange an alternative collection time.
8.1 We will carry out all waste disposal and collection activities in accordance with applicable laws and regulations in England and Wales, including those relating to waste carriage, transfer, treatment and disposal.
8.2 We will transport and dispose of waste only at authorised facilities and in line with current environmental and waste management regulations.
8.3 The Customer remains responsible for ensuring that any information provided about the waste, including its nature and classification, is accurate and complete. If we reasonably believe that the waste is hazardous, misdescribed or not suitable for our standard service, we may refuse to collect it or may charge additional fees for safe handling and disposal.
8.4 Where legally required, we may issue or request waste transfer documentation recording the transfer of non-hazardous waste from the Customer to us. The Customer must retain copies of such documentation as required by law.
9.1 The Customer must ensure that the collection area is as clear as reasonably practicable and that access routes are free from obstructions and hazards.
9.2 We will use reasonable care and skill when providing the Services. However, the Customer is responsible for protecting driveways, paths, surfaces and surrounding property which might be damaged by vehicles or the movement of heavy items, especially where access is tight or surface conditions are not suitable for heavy loads.
9.3 If the Customer asks us to position vehicles or equipment in an area that is not suitable or that may present increased risk of damage, this will be at the Customer's own risk and we shall not be liable for any resulting damage, except where caused by our negligence.
10.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be excluded or limited.
10.2 Subject to clause 10.1, we shall not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity or loss of goodwill arising out of or in connection with the provision of the Services.
10.3 Our total aggregate liability to the Customer arising out of or in connection with any single event or series of connected events shall not exceed the total amount paid or payable by the Customer for the Services giving rise to the claim.
10.4 We shall not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, lockouts, industrial disputes, breakdown of systems or equipment, power failure, or changes in law or regulation.
11.1 The Customer warrants that they have the legal right to dispose of the waste presented for collection and that the waste does not contain any items that are stolen, unlawfully obtained or otherwise in breach of any legal or contractual obligation.
11.2 The Customer warrants that the waste does not contain any hazardous or prohibited materials unless specifically agreed in writing and handled in accordance with applicable regulations.
11.3 The Customer agrees to indemnify and keep us indemnified against all claims, losses, damages, costs and expenses arising from any breach by the Customer of these warranties or any other term of these Terms and Conditions.
12.1 If we are unable to complete a collection due to circumstances within our control, we will arrange a re-visit at no additional cost to the Customer at the earliest reasonable opportunity.
12.2 If we are unable to complete a collection due to inaccurate information provided by the Customer, lack of access, unsafe conditions or the presence of prohibited waste, we may charge a reasonable missed collection or call-out fee.
12.3 Any concerns or complaints about our Services should be raised with us as soon as possible so that we can investigate and, where appropriate, take corrective action.
13.1 We may collect and process personal data relating to Customers for the purpose of administering bookings, providing Services, processing payments, and handling enquiries and complaints.
13.2 We will handle personal data in accordance with applicable data protection laws in the United Kingdom and will take appropriate technical and organisational measures to protect such data.
13.3 Customers are responsible for ensuring that the personal information they provide is accurate and up to date and for informing us of any changes.
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our Services, legal or regulatory requirements or market conditions.
14.2 The version of the Terms and Conditions in force at the time of the Customer's booking will govern that particular booking, unless a change is required by law or regulation.
14.3 We may revise or withdraw any aspect of our Services at any time, including pricing and service coverage, but will use reasonable efforts to honour existing confirmed bookings or to offer suitable alternatives.
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
